These Terms of Service ("Terms") govern your use of kincostrategies.com (the "Site"), operated by Kinco Strategies LLC ("Kinco," "we," "us," or "our"). By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site. These Terms apply to visitors located in the United States.

About Our Content

The information on the Site is provided for general educational and informational purposes. It describes how Kinco thinks about business risk and protection, and it is not legal, financial, tax, or insurance advice. Reading the Site, taking the Risk MRI, or chatting with Taurus does not create a professional or advisory relationship. Any engagement begins only under a separate written agreement with Kinco Strategies LLC.

The Risk MRI and the Taurus Assistant

The Risk MRI is a self-assessment that runs in your browser. Its score and findings are general and based only on your answers; they are not a professional assessment of your business. Taurus is an AI chat assistant whose replies are generated automatically and may be incomplete or wrong. Nothing Taurus says is advice, a quote, or a binding statement by Kinco.

LegalShield Plans

Kinco Strategies LLC is an independent associate of LegalShield. Instant Legal Access is a LegalShield membership, and the Site links to LegalShield's enrollment site for it. The plan, including access to legal counsel and identity protection, is provided by LegalShield and its provider law firms under LegalShield's own terms, and your relationship for that plan is with LegalShield. Kinco Strategies LLC is not a law firm, does not give legal advice, and may be compensated for referrals.

Benefits and Insurance

Kinco Strategies LLC does not give insurance advice through the Site. Any insurance product discussed in an engagement is offered by the licensed carrier or agent named at that time, under that carrier's or agent's own terms.

Your Use of the Site

You agree to use the Site lawfully and not to interfere with its operation, attempt to gain unauthorized access to any part of it, use automated means to scrape or overload it, or use it to harm others. We may change, suspend, or remove any part of the Site at any time without notice.

Accounts and the Sign-In Area

A private area at /dashboard is limited to accounts that we create; there is no public sign-up. If you have an account, you are responsible for keeping your login credentials confidential and for activity under your account. Access is personal to you, is non-transferable, and may be limited, suspended, or ended at our discretion.

Submissions

When you send us information through the contact form or Taurus, you represent that it is accurate and that you have the right to share it. If you send us feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation to you.

Intellectual Property

The content, design, and branding on the Site belong to Kinco Strategies LLC or its licensors unless stated otherwise. You may view and share our content for your own non-commercial use, but you may not copy, republish, or use it commercially without our written permission. LegalShield and other third-party names are the trademarks of their owners.

Third-Party Links and Services

The Site links to third-party websites and services we do not control, including LegalShield and our meeting link on Zoom. We are not responsible for their content, practices, or terms, and your use of them is at your own risk and subject to their terms.

Disclaimer of Warranties

To the fullest extent permitted by law, the Site and its content, including the Risk MRI and Taurus, are provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including warranties of merchantability, fitness for a particular purpose, accuracy, title, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that its content is complete, current, or suited to your circumstances. Decisions you make based on the Site are your own.

Limitation of Liability

To the fullest extent permitted by law, Kinco Strategies LLC and its owners, members, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of or inability to use the Site, even if advised of the possibility. Our total liability for any claim relating to the Site will not exceed one hundred U.S. dollars. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

Indemnification

You agree to indemnify, defend, and hold harmless Kinco Strategies LLC and its owners, members, and affiliates from any claims, losses, liabilities, damages, and expenses, including reasonable attorney fees, arising out of your use of the Site, your submissions, or your violation of these Terms or applicable law.

Governing Law and Venue

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict-of-laws principles. Any dispute relating to the Site will be resolved in the state or federal courts located in North Carolina, and you consent to their personal jurisdiction and venue.

Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date. Continued use of the Site after a change means you accept the updated Terms.
